Quote from "Wikipedia"
Possession of child pornography, including those depicting real children, is legal in Japan. Distribution of child pornography was made de jure illegal in 2003 after international pressure from the United Nations, UNICEF and other international organizations, although the law made a distinction between hardcore pornography and the softcore pornography that is widely available in Japan, such as at junior idol and lolicon media centers like Akihabara and Nipponbashi, and at most large electronic store chains, such as Sofmap. Prosecutions have been made under the new law by Japan's powerful prosecutors under Japan's unique legal system, resulting in some financial verdicts, with relative strictness of enforcement continuing to vary by prefecture.

[...]

Today, the law permits the simple possession of child pornographic images if there is no intention of selling or distributing them, with child pornography being defined to be explicit images of children having sex, and not the nude and semi-nude images of children that are common in the Japanese child idol industry.

[...]

Although not always considered explicitly pornographic, media portraying young idols is a large industry in Japan. Although generally lacking nudity, photobooks and videos of underage models in scant, tight fitting and revealing clothing are often taken to be provocative and pornographic in nature. Today, this industry remains lucrative, with The Japan Times reporting an estimated 3 million idol photo books sold between 2006 and 2007. Models are categorized under age groupings, ranging anywhere from 18 years of age (U-18), to as young as 3 years old (U-3). Child models in Japan are not seen in the same light as in the West, with many models gaining large fan bases and being offered acting, singing, or promotional careers.

Basically possession of child porn and distribution/production of nude and semi-nude shots of children in erotic poses are legal in Japan and I think that's a bit worrisome. That the age of consent in Japan is 13 doesn't help either. I think that's way too young to consider the weight of your actions.

Well, what do you think about this?

i'm a shotacon, but only the 2D kind. it's quite worrisome that possession is okay. i mean, where the hell you get that image eh?

on one hand i think the idol-thing is quite in bad taste (like the child pageant in america) but on the other hand it's better to not ban it and have it move underground.

I think if you were to do a test on virginity in every countries there are in the world. Japan would have the most under aged female that have lost virginity. But Japan would also have more ''20+ but still virgin ppl'' than the West.
Well, It's just an assumption based of what I know, but they surely doesn't have enough restriction on those kinds of thing.

It is indeed worrying. Blame the Japanese government for focusing on the wrong things. Like trying to ban anime and manga that "can corrupt children" and censor porn and anything that "corrupt" children. But banning child pornography in a whole? No way, that'll hurt the economy or something stupid. It is as if the politicians themselves own some. >_>
To be honest, I think that everything that depict a real underage person in a sexual situation should be illegal no matter what. Now now, let me explain before you jump to conclusion.
I do not talk about 2D drawings/animations or 3D renderings nor do I say that producing junior idols and selling their photos and DVDs should be illegal. It's the thing where children have sexual activities. Yes, I know, a disgusting thought etc etc...
But why shouldn't junior idol(ing?) be illegal? Because I see no reason for it. A junior idol doesn't necessarily have to be in a almost transparent white swimsuit or minimalistic sexy underwear. They can actually be singers and actors or serious models for fashion magazines. They could tone down the sexual stuff though, but that goes for almost everything in this rotten world.

By the way, if I remember correctly the age of consent can be made useless if a prefecture have ordinances that prohibit sexual activities with anyone under 18. At least one step forward, but how many steps backward do they make for every step forward? A lot of them apparently as sexual activities don't include handjobs and other activities that don't have penetration. :/

As for when the age of consent should be... I guess 15 is preferable. Any higher and it just feels somewhat ridiculous and overprotective. Any lower and it's too close to the red zone.

tl;dr
Some things should be dealt with harshly, some not so much. Japanese government is a lazy stupid government filled with pedophiles. laugh

Eh.. I've seen some statistics on that and it looked similar to the west. I don't think teenagers in Japan are actually having sex earlier than in other countries. But I agree about the 20+ part. There's more people in Japan who are isolated from the opposite sex or want to wait until marriage.

Not so much pedophiles but more like easily bribed by the industry. But that goes for politicians in basically all countries.

The age of consent is not 13 in Japan, it varies by prefecture. The lowest age of consent is 13, the highest is 21 I believe.

The distinction you're totally failing to make is national law vs. prefecture law.

Abortion has always been legal in the US, but at various points, it's been illegal in certain states.

Likewise, having sex with a consenting 13-year-old is legal in Japan, but it's illegal in certain (most) prefectures.

Anyway, I agree with the general opinion that the national age of consent should be raised, maybe to 16.

As for the underage sex statistics, I think michelle is just too blinded by the hilarious quotes from certain h-manga I've seen, such as "you know, it's normal nowadays for a 6th grader to lose her virginity" (this being from said girl's mom... h-manga are really weird sometimes). If we were to believe h-manga, incest is really common in Japan, too (it's not).

The US still has more underage rape statistics (I assure you, the Japanese don't cover up crimes of that level nearly as frequently as we like to portray... as far as I know, the yakuza don't actually run underage brothels, which is the only situation in which that Japanese police might *actually* cover it up), so it's unclear to me that the child porn, however horrible it is that it exists in the first place, is actually damaging to their culture as a whole....

What we really need to have happen is the UN stepping into nations where making CP is still legal, and just stopping it at the source. Those are the people that are *actually* harming kids' lives.

What's that saying goes? "if you have enough money, even demons will be your slaves.".

Air pollution killing people? Hand over the cash and the jobs and the government will sweep it under the rug. Hand over some more cash and even the people will keep silent! Need us to hand over that innocence person there so you can put him in jail? No problem, just keep that trade agreement and other favourable things to our economy and we'll happy to hand him over to you; might even throw in a few made-up crimes to make it more convincing.

The same thing happened to slavery. It was a big business back then. Nobody could do anything to it. The most effective method wasn't laws or rules or even enforcement, it was economic attack. Once the slavery industry was weaken enough, it was destroyed with laws.

That aside, I think a lot of people got it wrong about kids and junior idols. They tend to make them into miniature version of adult idols rather than being just kids. In the US, you get parents putting on make up and hair style like an adult for their kids to win some beauty competition. The junior idol industry really big in the US. Imagine if it was national scale equal to music and such. Japan is pretty much doing the same thing but on a larger and much more pervasive scale.

What's bothering me..
While I think that a person, who is taking a picture of a nude kid, for example while bathing in the sea, for his own "use" and not distribution is doing something bothersome but not actually evil (when you think about it nobody is actually harmed by this), I think that production of such pictures (meaning, that the child is more or less aware of what it's doing) is just gruesome.. And the distribution part is even worse - especially when it comes to idols, who are known by their name - putting the whole psychology aside (which is very important but pretty much obvious), how will their school/work life be affected?
While the first example - possession of nude images NOT in sexual poses might even be consider "the lesser evil" - someone might look at the photos instead of pursuing actual children, the production and possession of "actual" pornography and distribution of any kind of nude images should be banned.

Is about what I think would be right. With the stress put on possession and distribution, because if production is banned someplace, it's very likely to just change place to some other country.

yeah... their laws regarding pornography does seem sort of half assed in some cases like censoring pornography instead of just prohibit it. and that whole prohibit child pornography in manga and anime seems kind of strange considering they allow possesion of REAL child pornography. i mean sure there might be good reasons for prohibiting those kinds of manga and anime but arent the priorities kind of backwards in this case?

from reading manga and googling around a bit you get the impression thart their anti prostitution laws are kind of halfassed as well and that they allow a lot of services that would be considered prostitution in most countries.
and yes i know that drawing conclussions just from manga and the internet isnt exactly reliable but still this is my impression,

Well, reading this topic was disturbing, to say the least - Especially considering the age-group I currently fall into...

But for my two cents, I haven't much to say, really. I simply think they should ban the child porn, but as that is the common opinion, that's not too helpful, huh? ^^'
I do think their priorities are backwards, they should definitely get rid of real porn before they get rid of fake porn - if they really need to get rid of fake porn at all. I mean, c'mon, it's just drawings. Maybe have a separate section of the bookstores and DVD stores for such things, if you want to prevent children from seeing them, but banning it altogether seems a little harsh.
I don't particularly care if they ban the stuff, but I'm aware that others enjoy it, and whatever floats your boat.

Rather than banning child porn or porn this porn that... If what you're worried about is physical age in relation to sexual image, I personally find that noot quite so important. (Again, just a personal opinion) I think people should be more stressed on the MENTAL age aspect, how old mentally should someone be to be able to properly handle all aspects of sex? (As in everything from the act itself to properly raising the result of it.) Different people mature at different rates, some people hit (physical)30s, 50s, and still can't be called "fit" to be a parent. Others may be just 14 and already be more skillful at it than the average person. After getting that down and figuring out how to measure it, then it'd make more sense to start worrying about who is allowed to do what.

Yup, rambling.

wotonito should be shot lol
but seriously

of course something is wrong when the gorvernment basically says it is ok to have videos/pics,99tb worth of 40+yo men/woman fucking 5yo girls/boys
just as long as you are not going to sell it for profit
and hopefully...not go out and rape or pay children to stroke your cock for 500yen/ejaculation[unless they work in pinksalons or that line of work coz...then its ok]

idol videos are...a bit diffrent... moraly speaking not much...but atleast no cock is penetrating something and when we are talking about 5-12year olds that is a good thing

this is what happens when views on females have not changed for x00years
and when a rampaging free market demands tribute

Japan has one of the lowest crime rates of the developed world, so of course they need your help to protect their children because obviously, their laws are not working when the crime rate is so low. And of course, the policy of banning everything really has helped Western societies. Just look at the data.

Seriously, I don’t object to any individual having and expressing personal preferences, but I am really perturbed by so called moral guardians who seek to impose their personal morality onto foreign societies and cultures.
Instead of worrying about the children raised in one of the safest countries of the developed world you should be worried about the likes of Canada and Australia, who have the highest rape rates of the developed world that by the way, also have strong anti-porn laws.

No, taking pictures of a nude, unconsenting child is already illegal for the same reason that taking pictures of a nude, unconsenting adult is illegal, and that part shouldn't change. Maybe if it's, like, a nudist colony, and there's a 100% guarantee of no commercial distribution, fine, but otherwise, I don't think that this should be legal.

[also there is porn made of nudist colonies and that is exploitation and should be stopped for reasons mostly irrelevant to this topic about CP]
