I agree with the child porn regulation. If anime was live action, alot of it couldn't be distributed or sold due to INTENSE child nudity and placing children in sexual situations. I'm suprised that it took until 2007 for people to think that upskirt shots of 8 year olds is a little out of line.

i guess japanese people haven't looked at the failure of the music industry to breakdown the "thieves". because obviously they are doing a good job keeping their music in the cd's. but yeah this is not that big of a deal they can't target only one country(being us) and expect everyone else to follow the lead. hell. people from UK can sub it and put it up on web for all we know and it will be perfectly fine

I'd have to say no. Despite the size of the community that reads/creates scanslations, licensed stuff can be read in a book store anyways, and by and large people prefer book form rather than having to sit in front of a computer to read manga. Keeping that in the impact of scanslations is quite different from fansubs where there isn't a place where you can watch the whole of a dvd for free and there's little difference (besides quality) in watching anime on a computer screen or a TV.

I can understand them wanting to restrict the distribution of their copyrighted material, the problem is what is defined as copyrighted. By the current laws if the material is openly broadcast (TV, Radio, etc.) it is not illegal to record and share it. They can crack down on fansubs with DVD Raws though since it's not broadcast media. At least that's the answer that lets the sites run with no problems. Besides fansubs are not 100% accurate...and a lot of people can't stand reading subs. Then again dub accuracy can be a lot worse than the fansubs...

Is that US copyright laws or Japn copyright laws because in the US, it is illegal to record and share things on television. I've taken alot of classes on copyright law and I can tell you 100% that its against the law. The thing is that in Japan (and here) when you watch TV shows its paid for by the commercials that are ran. When is the last time you've seen a fansub with commercials in it?

Copyrights are the rights to copy and distribute intellectual property. Fansubbing by default is a method of circumventing both of those. You didn't mention this, but there is no provision for, "if its not licensed, than its ok to copy and distribute it as you see fit." The copyright holders still own the copyrights and if they wish to not distribute it in the US yet, thats their right. And for Anime, alot of time they aren't even given time to distribute it in the US. A show can air on Monday and be online by Wed morning.

but i doubt they'll get to regulating manga anytime soon, from what I know there's a much bigger profit in anime so i don't forsee them trying to regulate manga until it becomes a economic loss
