Japanese Internet Providers Cracking Down on File-Sharers

Comcast is getting heat because they are a prime example of -False Advertising-. In the contracts they signed with customers the customers were to pay for a certain amount of bandwidth, and Comcast was violating the contract by not providing that amount of bandwidth at all times like they were supposed to. On top of this, they didn't say they were going to limit people's bandwidth in certain situations (like torrenting), which effectively means they were not providing on their end, and in a way stealing their users bandwidth when they felt they were using too much.

ISP's have access to -all- of the information being passed through them by your computer. The only way to bypass this is if the information is encrypted. And you can't encrypt your ip from your provider. What many ISPs are thinking of doing is simply detecting if certain software is running on a computer, and then limiting bandwidth if it is. However this will simply lead to new p2p that hides itself from any lines of transfer, and then simply relies on fully encrypted data. It might take a little longer to process.. but voila, no limiting of data.
On top of this we have mediums like mIRC, and the direct download fileshare providers (all of which are being used more often now.) mIRC already utilizes encryption, making it one of the safest methods.
And then there is other software that can block off third party connections from detecting your transfers.
This is just more of the stupid things companies do to waste time and money. In the end they might save five dollars, and everyone (them and society) simply will invest time and effort which was generally unnecessary... Corporations will never be able to keep up to the thousands of people with too much time on their hands who program/crack/distribute etc...

I don't think it's so much that these people have time to waste on their hands, but probably lots of them enjoy the challenge of breaking open someone else's work to not let them and others have their candy. >D
