even though it was implied Orochimaru seemed sure enough that it might have been him. so yeah it's up in the air on whether or not it was him. but if it was then it would lead to a lot of questions on the seal. plus i doubt Kabuto and Orochimaru might try to use that jutsu again though. it requires a lot of material it seems just to use it.
