FYI, here are some easy ways to end up with a DUI:

Drive to work the morning after having a few beersthe night before (Hangover is a DUI)
Driving while on cold medication (cold and allergy meds are drugs).
Have as little as .01 Blood Alcohol level if you are a minor
Riding a bicycle or skateboard after drinking.
Sometimes being intoxicated in a car whose driver is drunk can get a DUI for everybody.
Having a beer while tuning-up the car
Being in possession of your own car keys while being drunk

I don't know about you, but cold medication seems to be excusable. Because first of all, your body produces alcohol in its own right. If you are sick, and you take cold medicine because you need it -- I can guarantee you that no judge in their right mind will slap a DUI onto a minor's driving record for that.

Riding a bicycle? I haven't actually heard of that, but doesn't DUI stand for "driving" under the influence? On a bicycle, you are not driving. You are pedaling. I'd argue that case, also.

I also can't see how if you're drunk and you're in a car with someone who's driving who is drunk... makes you able to be labeled as "driving" under the influence. I'd argue against that case, also.

Now, tuning up your car while having a beer is just silly. The machine is not on. You are not driving. I'd argue against this case.

Being in possession of your own car keys while drunk. What the hell. Again, you're not driving. Again, what are you supposed to do with the keys? Oh, I'm drunk, to not get in trouble, hey, random guy beside me. Take my keys to my new Mustang.

What country are you from? I don't think rules here in the US are that strict. At least, from a common sense point of view, you should not ever be arrested for something so stupid. As long as you use common sense and not endanger anyone while being intoxicated, everything should be fine.

I live in Los Angeles CA. If you don't believe me about any of those scenearios just start googling.

If you read the side of the medicine package you will see a a phrase there that says "Do not drive a car or operate heavy machinery." This is because some cold meds can "intoxicate" you. Benedryl, Nyquil, Motrin, etc. If you are pulled over and you look spaced out from Tylenol PM, they will give you a DUI.

Kids get DUIs too, the tolerance is so low because they are already breaking another law by drinking under age.

The law is written so that if the ability and intent to operate a vehicle while intoxicated can be shown, the person can get a DUI. So if you happen to be drunk and walking down the street that your car is parked on you can get a DUI if you are in possession of the keys.

Likewise, tuning up your car is considered in the "normal" range of operation. If you are drinking while "operating" your vehicle, you can get a DUI.

A person can get a DUI while operating any wheeled vehicle.

And lastly, they can give everyone who has been drinking a DUI for being in a car operated by an intoxicated person. I never understood the logic for this, but I know it is true. When I got my DUI 2yrs ago, I dsat through hours and hours of education videos and speeches about DUI and everything related to it.

Life is tough......but it's tougher if you're stupid.

it does sound too strict but i belive it. my school is so into the issue, espaciely my teacher, so we have newspaper titles hanging on the walls, and all 11th graders have 1 hour a week of "transportation" class (an ex sports teacher that comes and drills into our brain about drunkndrive) and once in a while a special lecture. theres even a test in the end of the year. and the discipline director monitors the number of ditching from this class. so i can understand all those laws.

and about the cold medicine thing, you can get drunk from every thing. when i was on cold medicine (i was so sick i cought instead of breathing, lucky to be alive) and had to go to summer school, i believe i slept through it all. cuz i dont have a single memory from those months.
you can also get "drunk" if ur diving. its called "dephts drunk" or something like that. i got it once, when i dived to -30m, and i tried to convince my partners to change the signs language. when we got out of the water, i was lought at as the "kiddy who cant tolarate dephts" (i was 12), but some ppl actualy died from it, when they decided they dont need the air gear. under water.

I never drive drunk, tho i have ridden with someone who was before. I regret that. If I can't get a sober ride, I just tell the person I'm sleeping on thier floor, take my shoes off(it's the rule), and pass out.

I don't know about good luck. Maybe he should be suspended instead for being such a bad driver and a potential threat to everyone on the street.....I mean, isn't never drink and drive the whole meaning of this topic? Obviously he's trying to teach us about his wrongs.

hey, i think he obviously learned his lesson, but for the last thing he wasn't really at fault. of course he would run away when someone wants to shoot him. for that i wished him good luck. for the drink and drive thing that happened 2 years ago, he already paid for it. he said it himself that he didn't drink since then. but they don't trust him because he has a record.
