With a samurai sword O_o
BALTIMORE - A Johns Hopkins University student armed with a samurai sword killed an intruder in his garage, Baltimore police said Tuesday.
Two laptops and a Sony PlayStation had been stolen by burglars Monday from the home, on University Parkway just blocks from the school, said police spokesman Anthony Guglielmi. Early Tuesday, one of the four Hopkins students who live in the home noticed the garage door was open and took a sword with him to investigate, Guglielmi said.
In the garage, the student told police he discovered a man and when the student told the man to get out, the man accosted him, Guglielmi said. The student defended himself with the sword, cutting off the man's hand and causing a severe laceration to his upper body, he said.

He could have used a less deadly weapon but good on him for fighting back and a samurai sword is way cooler than a baseball bat. I hope the cops let it slide as self defense.
The pen is mightier than the sword...and considerably easier to write with.
I'm surprised the burglar didn't pull a gun on the man.
Yeah it would be sad to see him going to jail for defending his property, although he did use excessive force.

Heh, that's badass. The bastard deserved it. He broke into the property and should have been prepared. It's sad that the kid will most likely get something held against him. Deadly force isn't allowed unless it's that type of situation. Kind of BS in my opinion. They should make stuff like this legal. Great way to get rid of societal garbage. Seriously, what if the dude was alive, went to jail for a bit, then came back for revenge? Just wipe em out. Enemies aren't friends ;D Population control <3

First off, who here has a samurai sword? I'm not talking about the imitation swords you can pick up off the internet, i mean an authentic japanese sword complete with the license. For all we know, the samurai sword he was using is an imitation or decorative sword, which are still made of metal and although they are dull, when using enough force it can cause lacerations and serious damage.
Secondly, excessive force is relative. What you call excessive force, the guy at the moment when confronted with a burglar may not deem it as excessive, especially when being accosted. Honestly, if you were holding a sword and a guy tried to attack you, anything you do from that point on isn't excessive if he rushes in knowing you have a sword.
Lastly, since i doubt he has official police training, and hopefully isn't a blackbelt in any martial arts (i'm assuming so if he's using a sword) then the reason the police are asking questions before pressing charges is because they need to find out what kind of person he is. If he has the skill and training to determine what excessive force is and how to neutralize someone without exceeding necessary force, then he has a duty to do so. If he is just a normal guy who had a sword collection, that's a different story. He was never trained to know what excessive force is, therefore his definition of it will vary from that of a cop or militant.

They should make stuff like this legal. It is legal in many states.
First off, who here has a samurai sword? I'm not talking about the imitation swords you can pick up off the internet, i mean an authentic japanese sword complete with the license. For all we know, the samurai sword he was using is an imitation or decorative sword, which are still made of metal and although they are dull, when using enough force it can cause lacerations and serious damage. Real swords can be bought off the internet too. If your definition of real sword means it can cut your hand off and won't break when you swing it around. They are usually sold along side the decoration ones with very little distinction between the two. There may be a disclaimer saying the sword is real and its super dangerous, and its usually more expensive.
Sarcasm just doesn't work over the internet.

I doubt he'll get in any trouble, self defense is legal in america, and I doubt he'll get arrested for using excessive force, which in america usually means extra 20-30 gunshots after the guy has long been dead, and it sounds like this dude only swung the sword once or twice towards the robber.

I don't think he should be arrested. Self Defense. Only difference was he used a bad-ass sword instead of a bat.

Eh The robber would see his sword and if he went to accost him after that it's not excessive force.
If I run at someone pointing a gun at me and I get shot, it's also not considered excessive.
Also from what it says, he cut off the persons hand, and damaged his torso. It also says "Died at the scene" implying he died after the cop arrived, so it's not like he went to kill him, he probably just swung, cut through his hand, and the blade followed through across the torso, causing him to bleed out.
So yeah, no difference than hitting someone with a baseball bat, except it's more awesome.

Manslaughter is only if deadly force wasn't needed. An intruder accosting you despite see'ing a weapon is certainly a threatening situation.
Also since it sounds like he aimed for the intruder's hand (which remember, he was being accosted), he didn't intend to kill him. Therefore no malice with intent to kill, and no manslaughter.
