he was sealed along with the Kyuubi!!! The whole death god jutsu seals both the target and the user's soul. This got explained a long time ago by Sandaime when he used the jutsu against Orochimaru

4th died... The only reason he appeared from naruto's mind is because i guess it was part of the jutsu where he sealed not only the 9 tails but also memory of himself or his "mind" into the seal. So even if he is dead physically his memory is within naruto.
